1. INVOICING AND PAYMENT TERMS:

• The agreement is concluded and signed by the client on the day the vehicle is picked up. The payment for the rental must be made in full immediately.
• The rental period is calculated on a 24-hour basis. If the rental starts at 10 AM, the vehicle must be returned by 10 AM at the latest, unless otherwise agreed with the rental company manager.
• If the client shortens the rental period after the rental agreement has been signed, the rental cost for the unused days will not be refunded.
• Rental with the «No Deposit» option means there is no deposit required. However, the customer agrees to promptly pay all fines, tolls, and other rental-related expenses upon receiving notification.
• All payments must be done in USD. If payment is made in any other currency, conversion will be applied at the fixed internal exchange rate of FCR Group on the day of payment. Please contact your manager for details.

2. DRIVERS AND DOCUMENTS REQUIREMENTS:

• All drivers must be over 21 years old and have more than 1 year of driving experience. Drivers must provide a valid international or national (local) license or both of them, passport or ID.
• Drivers must not be under the influence of alcohol or drugs while operating the vehicle. All insurance claims resulting from driving under the influence will be denied and you will be responsible for all resulting damage repairs. It is primarily your responsibility to ensure that you are eligible to drive a rental car in compliance with the laws of Georgia.
• It is prohibited to pass the vehicle to any third party or individual who is not listed in the Rental Agreement.

3. DELIVERY AND RETURN:

• The vehicle is delivered to the Renter in good overall condition and without apparent defects and any complaints as to its condition must be made to the Lessor immediately upon delivery. The Renter agrees to return it with all documents and accessories and in the same condition to the Lessor at the location and on the date designated in this agreement. The Lessor reserves the right to repossess the vehicle without demand at Renter`s expense if the vehicle is used in violation of this agreement.
• All accessories, such as phone holders, child seats, boosters, chargers and cables, branded accessories, etc., must be returned with the vehicle in the same condition and quantity as they were provided to the client. Otherwise, the client agrees to reimburse the cost of the items and the cost of any repairs or cleaning needed. Fuel policy – Full to Full. Carwash policy — Clean to Clean.

4. RESTRICTION:

• Travel along the ‘Mestia – Ushguli – Lentekhi’ route is permitted only for vehicles equipped with the travel authorization option and is allowed exclusively during the period from May 1 to September 30.
• Off-roading, rallying, reckless driving, racing or ‘drifting’ in our vehicles is strictly prohibited. Going to off road, unpaved roads, or outside of the public roads, and tracks is not allowed — it results in an additional fine of up to 1500 GEL. It is also forbidden to cross the Georgian border in a rented car.
• The vehicle’s movement is monitored via an installed GPS tracker. Exceeding the established speed limit by more than 30 km/h, as recorded by the GPS tracker, is strictly prohibited. In addition to government-issued fines recorded by traffic cameras, if speeding is detected via the GPS tracker, the renter may be required to pay a service fee for speeding.
• The driver must return the car in the same condition it was received. If the car is dirty, has food residues, stains, mud splashes, dust, or sand on the exterior or interior that were not present at the time of delivery, an additional fee starting from 20 GEL will be charged. If interior detailing is required due to stains, pet traces, etc., a cleaning fee of up to 700 GEL may be charged.
• When returning the vehicle with missing fuel, the customer is required to pay for the full cost of the missing fuel and an additional service fee of up to 50 GEL, depending on the vehicle return location. Missing key (lost) fee — up to 2000 GEL. Missing (lost) documents fee — 400 GEL. The “Mestia – Ushguli – Lentekhi” route option is a paid service. The cost of this option is 150 GEL, unless otherwise specified in your voucher. Upon entering the specified locations, as recorded by GPS trackers, the client agrees to pay the full amount if it has not been settled at the time of signing the contract.
• Pets are not allowed in our vehicles. Smoking in our vehicles is strictly prohibited as it damages our vehicles and is a safety hazard while driving. Smoking in our vehicles may result in a charge of up to 1100 GEL.

5. MILEAGE USAGE:

• Allowed mileages limited as per the contract typically for premium class cars 250KM per day, 1500KM per week or 4500KM per month and unlimited for economy and middle class cars. Extra usage will be charged at the rate from 0.5 GEL per KM, depending on the cars. Monthly Rental Counts as 30 days. Restrictions and rates are specified in your voucher.

6. FINES:

• All fines for violation of traffic rules, parking rules, etc. must be paid by the client within 48 hours from the moment of notification.
• If the fines are paid via transfer to our company’s account, the client agrees to pay a service fee, as well as VAT on the service fee amount.
• If the fine causes the car to be impounded, an additional fee in the amount of 2 days rental price specified for the car will be charged.

7. INSURANCE TERMS:

• In the event of any accident or other damage to the vehicle, the renter is obligated to immediately notify the rental company and not move the vehicle from the scene of the accident until authorized by the rental company. Otherwise, the insurance policy may be voided, and the client will be pay and responsible for all direct and indirect damages to the vehicle’s repair costs.
• The Client (Lessee) acknowledges and agrees that, in the absence of a duly issued Police Report, any damages to the Vehicle occurring during the rental period shall be deemed the responsibility of the Client.
• All insurance and damage claims will require a Police Report in order to be processed.
• Note that wheels, glass elements and rims damages are not included into the standard insurance coverage and the renter is responsible for the cost of repair or replacement. See your voucher. Tire damage is not covered by any insurance policy. Any tire defects are paid for in full by the client, including tire installation, delivery and repair services.

8. GENERAL TERMS:

• As company policy, all terms, conditions and agreements between you and our company and our sales associates are required to be recorded in writing before being enacted. All rental and lease agreements will be governed by the applicable laws of Georgia. All applicable current and future government taxes and levies will be imposed as required by the laws of Georgia.

9. PERSONAL DATA:

• The Renter acknowledges the person-related data to this rental agreement automated process. He agrees expressly that these data can be communicated to third parties, especially for credit protection purposes.

10. GOVERNING LAW & JURISDICTION:

• This Agreement shall in all respects be governed by and be construed and interpreted and take effect in accordance with the law of the Georgia applicable to the city where it is executed and the parties hereto irrevocably submit to the non-exclusive jurisdiction of the courts of such city.
